Terms and Conditions

These Terms and Conditions govern your access to and use of the Accessibility Assurance Institute website, public scan tools, customer portal, widgets, reports, manual testing workflows, developer action tools, and related services.
1. Who we are
The Accessibility Assurance Institute platform is operated by Accessibility Assurance Institute, with address at 6 Quay Street, Skerries, County Dublin, Ireland.

2. Acceptance of these Terms
By using AAI, creating an account, running a scan, installing a widget, purchasing a plan, accessing a report, or using any part of the platform, you agree to these Terms.
If you use AAI on behalf of an organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.
3. What AAI provides
AAI is an accessibility assurance, scanning, evidence, remediation workflow, reporting, and support platform. It may include public preview scans, customer portal access, domain and page management, automated checks, manual testing workflow, developer remediation workflow, accessibility support widgets, reports, statements, and related services.
AAI helps organisations identify accessibility issues, manage remediation work, and preserve evidence of accessibility activity. AAI does not guarantee legal compliance, certification, or complete accessibility.
4. No legal advice
AAI may provide compliance-related information, risk indicators, accessibility guidance, reports, and suggested remediation actions. This information is operational and informational only.
AAI does not provide legal advice. You should obtain advice from a qualified legal professional where legal compliance, regulatory exposure, statutory obligations, procurement requirements, or dispute risk are material to your organisation.
5. Accounts and authorised use
You are responsible for providing accurate account information, keeping login credentials secure, managing access for users in your organisation, and notifying us promptly of suspected unauthorised access.
You must only scan, monitor, or configure AAI services for websites, domains, pages, systems, or content that you own or are authorised to assess.
6. Acceptable use
You must not use AAI:
- For unlawful, abusive, harmful, fraudulent, or unauthorised activity.
- To attack, overload, disrupt, or interfere with any website, system, or network.
- To bypass security controls or gather information from systems without authority.
- To upload malicious code or harmful content.
- To infringe third-party rights.
- To misrepresent AAI reports, badges, widgets, or statements.
- To claim legal compliance, certification, or endorsement where AAI has not expressly provided it in writing.
7. Public preview scans
AAI may provide a free public preview scan. Public preview scans are limited and may be rate-limited, restricted, changed, suspended, or removed at any time.
Public preview scans are not full audits. They may show automated findings, issue samples, severity information, manual test categories, or upgrade prompts. They do not replace a full accessibility assessment.
8. Automated results and manual testing
Automated scanning can identify many accessibility issues, but it cannot detect every accessibility barrier. Some accessibility requirements require human judgement, assistive technology testing, user journey testing, or expert review.
AAI results may include false positives, false negatives, incomplete findings, or context-dependent recommendations. You remain responsible for reviewing, validating, and remediating issues.
9. Plans, subscriptions, add-ons, and payment
Paid services may be provided through subscription plans, add-ons, page packs, managed manual testing, consultancy, custom work, or other paid arrangements.
Unless otherwise stated, fees are payable in advance. Prices may exclude VAT or applicable taxes. Payment processing may be handled by a third-party provider such as Stripe.
Failed, overdue, disputed, or rejected payments may result in suspension or loss of access to paid features.
10. Cancellation and refunds
You may cancel a subscription using the cancellation process made available in the platform or by contacting us.
Cancellation normally prevents future renewal but does not automatically refund fees already paid, unless required by law or agreed in writing.
11. Customer data and content
You retain ownership of your website content, account information, uploaded evidence, scan data, notes, reports, and other customer materials.
You grant AAI the rights needed to host, process, analyse, display, store, secure, and use customer data for the purpose of providing and improving the platform, supporting your account, generating reports, preventing misuse, and meeting legal obligations.
12. Data protection
Our processing of personal data is described in our Privacy Statement. Where AAI processes personal data on behalf of a customer, additional data processing terms may be required.
You are responsible for ensuring that your use of AAI complies with applicable data protection law, including where website scans, evidence uploads, notes, or reports contain personal data.
13. Intellectual property
AAI, the platform, software, workflows, reports, templates, text, graphics, branding, and related materials are owned by us or our licensors, except for customer data.
You must not copy, resell, reverse engineer, scrape, reproduce, or commercially exploit AAI except as allowed under these Terms or agreed in writing.
14. Availability and changes
We aim to provide a reliable service, but we do not guarantee uninterrupted availability. The platform may be unavailable due to maintenance, upgrades, outages, security work, third-party failures, or events outside our control.
We may update, improve, change, suspend, or discontinue features where reasonably necessary.
15. Disclaimers and liability
To the fullest extent permitted by law, AAI is provided on an “as is” and “as available” basis. We do not guarantee that AAI will identify every accessibility issue, make your website legally compliant, prevent complaints or claims, or ensure that reports will be accepted by any regulator, court, customer, public body, or third party.
Nothing in these Terms excludes liability that cannot be excluded by law. Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, loss of data, or loss arising from reliance on incomplete or incorrect scan results.
16. Suspension and termination
We may suspend or terminate access if you breach these Terms, payment is overdue, we reasonably suspect misuse, fraud, security risk, unlawful activity, or continued access could harm AAI, customers, third parties, or systems.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on our website or made available through the platform. If a change materially affects your rights or obligations, we will take reasonable steps to notify you.
18. Governing law
These Terms are governed by the laws of Ireland, unless another governing law is agreed in writing or required by law. The courts of Ireland will have jurisdiction, subject to any mandatory rights available to consumers or customers in another jurisdiction.
